The Points Based System

Beginning in the spring of 2008 the government will begin to implement a new Points Based System for UK immigration. This system is based upon the Australian immigration system and its creation is the biggest change to UK immigration in the last 40 years. The Points Based System will be separated into 5 different tiers under which migrants can apply to enter the UK. These tiers will replace more than 80 of the existing routes of entry to the UK. In addition the Points Based System will require employers of most migrant workers to obtain licences from the Border and Immigration Agency and sponsor their workers while they are living and working in the UK.

The first elements of the Points Based System to be implemented in the spring of 2008 will be:
  • Tier 1 routes of entry for highly skilled migrants; and

  • A new sponsorship system introduced for employers and organisations who wish to bring migrants to the UK for work or study.

The sponsorship scheme will radically change the duties and responsibilities of employers with migrant workers from outside of Europe. Details of the student sponsorship system will be introduced at a later date.
