Why do I need a Sponsor’s Licence?
- Without a Sponsor’s Licence you will be unable to sponsor most permit or visa holders
- It is your organisation’s duty to ensure immigration controls are applied in respect of your employees
- Your organisation will be scored and awarded a rating, which impacts on your current and future ability to employ current or future non-EU nationals
- Your organisation must be compliant with Home Office regulations or face significant fines and possible revocation of your licence
- If your licence is revoked your sponsored employees are at risk of enforced removal from the UK within 60 days of your organisation’s licence being withdrawn
- You risk civil penalties and criminal prosecution for negligence or evasion of the regulations
What is involved?
Become compliant / prepare
This requires the organisation to analyse and retain evidence of every employee’s ID and eligibility to work in the UK.
Apply for a licence
A detailed online application process. The questions are complex and require rigorous assessment of records and collation of data before proceeding.
Home Office visit
The Home Office will visit your organisation and perform an audit of your employee records. They have the right to interview any employee in the organisation, not only non-EU nationals. Effectively, your organisation’s human resource function is now responsible for immigration control of your migrant employees.
Remain compliant
If the organisation has handled the above steps in a compliant manner, a Sponsor’s Licence will be issued. This licence is valid for four years. During this time spot checks may occur and at renewal the Home Office will re-visit your premises.
