The recent introduction of minimum earnings and savings for settlement is causing numerous headaches. The rules are complicated and the information on UK Border Agency’s website does little to assist.
The UK Border Agency state that the new rules will protect the public purse. They are wrong. The only parties who benefit from this new rule are the lawyers as it will end up costing the public purse thousands of pounds in legal fees.
These rules will be challenged just like the crazy you must be aged 21 plus rule which was overturned, the HSMP fiasco etc etc etc.
The new maintenance requirement is unfair and until its overturned many families will continue to suffer.
The Joint Council for the Welfare of Immigrants (JCWI) have produced a document outlining the changes, United by Love/Divided by Law. It’s very comprehensive and the case studies are a really useful way to digest the rules and the impact on families.
