Before the Sponsor applies for an unrestricted or restricted COS, it is strongly advised that both employer and the skilled non-EEA national understand the requirements for a Tier 2 entry clearance or leave to remain application.
We advise clients to look at the nature of the job to firstly ascertain whether it is a skilled job on the UKBA list, or on the Shortage Occupation list. Salary must be above £20,000 however, the appropriate rate as set out in the Codes of Practice may be higher. Consideration must also be given to whether the position needs to be advertised and if the non-EEA national can switch to Tier 2 or is required to make an application from overseas.
